Murray Supervisor of Records December 14, 2021 SPR21/3168 Karen Totman Executive Secretary to the Superintendent Mohawk Trail Regional School District 24 Ashfield Road Shelburne Falls, MA 02019 Dear Ms. Totman: I have received the petition of Ben Tobin appealing the response of the Mohawk Trail Regional School District (District) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 29, 2021 Mr. Tobin requested: “…the redacted IEPs for out of district students for this year as well as the number of students in district who are out of district currently.” On November 30, 2021, the District responded. Unsatisfied with the District’s response, Mr. Tobin petitioned this office and this appeal, SPR21/3168, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a District representative, it is my understanding that the District intends on providing a subsequent response to Mr. Tobin. Accordingly, the District is ordered to provide Mr. Tobin with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Tobin may appeal the substantive nature of the District’s response within ninety days.
