Massachusetts Bay Transportation Authority 10 Park Plaza, Suite #7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Ryan Kath appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Kath requested “a copy of the investigation into the June 18, 2011 malfunction of an escalator at the Back Bay MBTA station.” Having received no response, he petitioned our office. Subsequent to the opening of this appeal, the Authority informed this office that they intend to provide a written response to Mr. Kath. Said response must be provided in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. If Mr. Kath is unsatisfied, he may appeal the substantive nature of the Authority’s response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
