Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite #3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Mary Schwager of WHDH-TV appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 17, 2021, Ms. Schwager requested “[t]he number of letters mailed to Massachusetts drivers in 2019, 2020 and 2021 (to date) informing them they needed an updated vision exam.” Claiming to not yet have received responsive records, Ms. Schwager petitioned this office and this appeal, SPR21/3200, was opened as a result. It is my understanding the Department provided a response dated December 9, 2021 to Ms. Schwager’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Ms. Schwager may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
