Beckta appealing the response of the City of Everett (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 3, 2021, Ms. Beckta requested, “[a] list of all employees as 10/31/2021, what department they work in and…their phone number and email address.” Prior Appeal The requested records were the subject of a prior appeal. See SPR21/3074 Determination of the Supervisor of Records (December 7, 2021). In my December 7th determination I found that the City had provided a supplemental response to Ms. Beckta on December 6, 2021. Unsatisfied with the City’s response Ms. Beckta petitioned this office and this appeal, SPR21/3201, was opened a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Beckta. Accordingly, the City is ordered to provide Ms. Beckta with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Beckta may appeal the substantive nature of the City’s response within ninety days.
