Records Access Officer City of Boston 1 City Hall Plaza Boston, MA 02210 Dear Attorney Williams: I have received the petition of Attorney Richard Fallon appealing the response of the City of Boston (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 4, 2021, Attorney Fallon requested “…all records including any electronic records in connection with the Sept. 20, 1995 arrest and booking of [a named individual]…in particular, I am interested in any record including a response by [the named individual] to any Miranda warning given to him in connection with that arrest and/or booking…My request here is looking for documents other than [a] booking sheet…” Previous Appeal The records sought by Attorney Fallon have been the subject of a previous appeal. See SPR21/3000 Supervisor of Records Determination (November 18, 2021). The City provided Attorney Fallon with an additional response on November 22, 2021. Unsatisfied with the City’s response, Attorney Fallon petitioned this office and this appeal, SPR21/3210, was opened as a result. Subsequently, I learned that the City provided Attorney Fallon with a supplementary response on December 15, 2021. In light of this, I will now consider this administrative appeal closed. Attorney Fallon may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
