G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 1, 2021, Attorney Avitabile requested, “…all public records involving motor vehicle accidents, commonly referred to as ‘accident reports,’ from November 22, 2021 to present…” The Department provided a response on December 7, 2021. Unsatisfied with the Department’s response, Attorney Avitabile petitioned this office and this appeal, SPR21/3224, was opened as a result. Subsequently, I learned that the Department intends on providing a supplementary response to Attorney Avitabile. Accordingly, the Department is ordered to provide Attorney Avitabile with a written response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
