Murray Supervisor of Records December 31, 2021 SPR21/3280 Kate Silvia Records Access Officer Department of Correction 50 Maple Street Milford, MA 01453 Dear Ms. Silvia, I have received the petition of Mark Arsenault, of the Boston Globe, appealing the nonresponse of the Department of Correction (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 20, 2021, Mr. Arsenault requested “… records showing the names, ages, sex, and date of conviction, for every person serving a sentence of life without parole in Massachusetts.” Claiming to not yet have received responsive records, Mr. Arsenault petitioned this office and this appeal, SPR21/3280, was opened as a result. Subsequently, I learned that the Department provided Mr. Arsenault with a response to his request on December 17, 2021. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Arsenault may appeal the substantive nature of the Department’s December 17th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
