Murray Supervisor of Records December 29, 2021 SPR21/3289 Michael Vigneux Records Access Officer City of Worcester 455 Main Street, Room 303 Worcester, MA 01608 Dear Mr. Vigneux: I have received the petition of Joseph Hennessey, Esq. appealing the nonresponse of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2021, Attorney Hennessey requested 11 categories of records concerning the Worcester Police Department. Previous appeal This request was the subject of a previous appeal. See SPR21/2980 Determination of the Supervisor of Records (November 19, 2021). Claiming to not yet have received responsive records, Attorney Hennessey petitioned this office, and this appeal, SPR21/3289, was opened as a result. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within 10 business days from receipt of the request. G. L. c. 66, § 10(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 10(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequently, I learned that the City provided Attorney Hennessey with a response to his request dated December 27, 2021. Where this matter was opened based upon the City’s lack of a written response, I will now consider this appeal closed. By email dated December 27, 2021, Attorney Hennessey indicated that he wishes to appeal the City’s response. The appeal is in the process of being opened.
