Murray Supervisor of Records January 3, 2022 SPR21/3304 Allison Mondello Primary RAO Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Eileen Morrison, Esq. of the Committee for Public Counsel Services appealing the nonresponse of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 3, 2021, Attorney Morrison requested the following records from January 2016 to present: 1. Compliance Audit Reports submitted by the submitted by the State Police Concord Barracks … 2. Quarterly Racial Disparity Stop Evaluation Reports submitted by the State Police Concord Barracks … 3. Quarterly Racial Disparity Search Evaluation Reports submitted by the State Police Concord Barracks … 4. Work Improvement Plans associated with numbers 2 and 3 above for [identified] Troopers … Claiming to not yet have received a response, Attorney Morrison petitioned this office, and this appeal, SPR21/3304, was opened as a result. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within 10 business days from receipt of the request. G. L. c. 66, § 10(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 10(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Despite being notified of the opening of this appeal, it is unclear if a response has been provided.
