General Counsel Human Resources Division 100 Cambridge Street, Suite 600 Boston, MA 02114 Dear Attorney Heffernan: I have received the petition of Peter Vickery, Esq. of Bobrowski & Vickery, LLC appealing the nonresponse of the Human Resources Division (Division) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 3, 2021, Attorney Vickery requested the following records during the period of January 1, 2018 to December 1, 2021: [1] Requests by the Department of Developmental Services (DDS) employees for religious exemption from any and all vaccine mandates…and for reasonable accommodations in connection therewith[;] [2] The number of such requests for reasonable accommodations granted[;] [3] The number of such requests for reasonable accommodations denied. Claiming to not yet have received responsive records, Attorney Vickery petitioned this office and this appeal, SPR21/3328, was opened as a result. Subsequently, I learned that the Division provided a response to Attorney Vickery’s request dated December 30, 2021. Where the basis of this appeal was opened as a result of the Division’s lack of a written response, I will now consider this administrative appeal closed. Attorney Vickery may appeal the substantive nature of the Division’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
