Box 606 Vineyard Haven, MA 02568 Dear Ms. Conklin: I have received the petition of Rich Saltzberg of Martha’s Vineyard Times appealing the nonresponse of the Town of Tisbury (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 6, 2021, Mr. Saltzberg requested the following records: [1] Any settlement agreement between the Town or its police department and/or its insurer and [named individual][;] [2] Any settlement agreement between the town and/or its insurer and [named individual] or [named individual] via a parent or guardian[;] [3] Any letter, email or other form of communication…from the Town or its police department from an attorney representing [named individual][;] [4] Any letter, email or other form of communication…from the Town or its police department from an attorney representing [named individual] or [named individual] via a parent or guardian. Claiming to not yet have received responsive records, Mr. Saltzberg petitioned this office and this appeal, SPR21/3340, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Saltzberg with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Saltzberg may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
