Murray Supervisor of Records January 11, 2022 SPR21/3371 Scott Besarick Sergeant City of Brockton Police Department 7 Commercial Street Brockton, MA 02301 Dear Sergeant Besarick: I have received the petition of Sean Hempseed appealing the response of the Brockton Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 9, 2021, Mr. Hempseed requested, “…a copy of the full police department duty roster for May 13, May 14, May 15, May 16, May 17, 2021.” Prior appeal The responsive records were the subject of a prior appeal. See SPR21/3338 Determination of the Supervisor of Records (December 29, 2021). On December 27, 2021, the Department provided a further response. Unsatisfied with the Department’s December 27th response, Mr. Hempseed petitioned this office and this appeal, SPR21/3371, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Hempseed. Accordingly, the Department is ordered to provide Mr. Hempseed with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hempseed may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
