Monahan, Esq, Assistant District Attorney Norfolk District Attorney's Office 45 Shawmut Road Canton, Massachusetts 02021 Dear Attorney Monahan: I have received the petition of David G. Magraw appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 7, 2021, Mr. Magraw requested various categories of records concerning the Office. Claiming to not yet have received a response, Mr. Magraw petitioned this office, and this appeal, SPR21/3381, was opened as a result. Subsequently, I learned that the Office provided a response. In an email dated January 13, 2021, the Office states, “Mr. Magraw’s counsel, Attorney Cormier (cc’d), has been provided records in connection with [a case] ; as such, we forwarded the requests to Attorney Cormier and inquired whether we should respond to Mr. Magraw directly. Attorney Cormier informed us that he would handle the matter and speak with his client.” In light of the Office’s January 13th email, I will now consider this administrative appeal closed. Mr. Magraw may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
