Murray Supervisor of Records January 10, 2022 SPR21/3388 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Ben Tobin appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 30, 2021, Mr. Tobin requested, “any and all communications/emails/call logs/transcripts related to PRS 5979.” The Department provided a response on November 9, 2021 suggesting a modification to the scope of Mr. Tobin’s request. That same day, Mr. Tobin agreed to the modification. Claiming not to have received a follow-up response, Mr. Tobin petitioned this office and this appeal, SPR21/3388, was opened as a result. Subsequently, I learned that the Department intends on providing a supplementary response to Mr. Tobin. Accordingly, the Department is ordered to provide Mr. Tobin with a written response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Tobin may appeal the substantive nature of the Department’s response within ninety days.
