Box 426 Vineyard Haven, MA 02568 Dear Chief Habekost: I have received the petition of Rich Saltzberg of Martha’s Vineyard Times appealing the nonresponse of the Tisbury Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 7, 2021, Mr. Saltzberg requested inspection of daily logs for ten (10) respective dates. Claiming to not yet have received responsive records, Mr. Saltzberg petitioned this office and this appeal, SPR21/3395, was opened as a result. Subsequently, I learned that the Department provided a response to Mr. Saltzberg’s request dated January 4, 2022. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. Saltzberg may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
