Massachusetts Bay Transportation Authority 10 Park Plaza Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Joe Difazio appealing the nonresponse of the Massachusetts Bay Transportation Authority (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 17, 2021, Mr. Difazio of the Patriot Ledger requested “…annual reports on crime statistics.” Claiming to not yet have received a response, Mr. Difazio petitioned this office, and this appeal, SPR22/0003, was opened as a result. Subsequently, I learned that the Department provided Mr. Difazio with a response dated January 6, 2022. In light of the Department’s January 6th response, I will now consider this administrative appeal closed. Mr. Difazio may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
