G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 29, 2021, Mr. Tobin requested: “…the redacted IEPs for out of district students for this year as well as the number of students in district who are out of district currently.” Prior appeal The responsive records were the subject of a prior appeal. See SPR21/3168 Determination of the Supervisor of Records (December 14, 2021). In the December 14th determination the District was ordered to provide a supplemental response. On December 27, 2021, the Department responded. Unsatisfied with the Department’s response, Mr. Tobin petitioned this office, and this appeal, SPR22/0006, was opened as a result. Subsequently, I learned that the Department responded to Mr. Tobin’s with a further response sent on January 11, 2022. Where the basis of this appeal was opened as a result of the Department’s December 27th response, I will now consider this administrative appeal closed. Mr. Tobin may appeal the substantive nature of the Department’s January 11th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
