Roche, Esq. appealing the response of the Town of Wilbraham Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. James Fiore requested certain records from the Department pertaining to an investigation. Unsatisfied with the response, on November 5, 2021, Attorney Roche, on behalf of Mr. Fiore, appealed to this office stating, “Mr. Fiore has not received a response to his request.” Previous appeals This request was the subject of a previous appeal. See SPR21/2996 Determination of the Supervisor of Records (November 16, 2021). The Department provided a response on November 15, 2021. Unsatisfied with the Department’s response, Attorney Roche petitioned this office and this appeal, SPR22/0033, was opened as a result. Subsequently, the Department provided a supplemental response on January 12, 2022. Given that this appeal was opened based on the November 15th response, I will consider this administrative appeal closed. Attorney Roche may appeal the substantive nature of the Department’s January 12th response within 90 days. See 950 C.M.R. 32.08(1).
