Murray Supervisor of Records January 28, 2022 SPR22/0088 Bou Lim Records Access Officer Brockton Public Schools 43 Crescent Street Brockton, MA 02301 Dear Bou Lim: I have received the petition of Ben Tobin appealing the nonresponse of the Brockton Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 15, 2021, Mr. Tobin requested “… copies of … [the] School’s special education program plan agreement as well as the policies and procedures…” Claiming to not yet have received responsive records, Mr. Tobin petitioned this office and this appeal, SPR22/0088, was opened as a result. Subsequently, I learned that the School provided a response dated January 27, 2022 to Mr. Tobin’s request. Where the basis of this appeal was opened as a result of the School’s lack of a written response, I will now consider this administrative appeal closed. Mr. Tobin may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
