Tapply, Esq. appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 16, 2021, Stephen Delcuze, Esq. requested, “[a]ll records related to the traffic lights at the intersection of Washington Street and Ukraine Way in the Dorchester neighborhood on or about May 22, 2019.” The Department provided a response on December 31, 2021. Unsatisfied with the Department’s response, Attorney Tapply petitioned this office and this appeal, SPR22/0132, was opened as a result. Subsequent to the opening of this appeal, the Department provided a supplemental response on January 26, 2022. Where the basis of this appeal was the December 31th response, I will consider this administrative appeal closed. If issues remain unresolved, Attorney Tapply may appeal the substantive nature of the Department’s January 26th response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
