G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 28, 2021, Ms. Shelly requested: “… all emails sent or received by the town forms system (foiadirect@townforms.com) that contains the following words/phrases, ‘2021-2327’. Date range from 12/15/2021-present. Please include all attachments…all emails sent or received by [named persons], or the technology series RAO that contains the following words/phrases ‘2021-2327’. Date range from 12/15/2021-present. Please include all attachments.” Prior Appeal The requested records were the subject of a prior appeal. See SPR22/0031 Determination of the Supervisor of Records (January 21, 2022). I closed my January 21st determination finding that City intended on a providing a supplemental response. On January 21, 2022, the City responded. Unsatisfied with the City’s response, Ms. Shelly petitioned this office and this appeal, SPR22/0143, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Shelly. Accordingly, the City is ordered to provide Ms. Shelly with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Shelly may appeal the substantive nature of the City’s response within ninety days.
