Gemme Office of the Town Clerk Town Hall 16 Lowell Street Reading, MA 01867 Dear Ms. Gemme: I have received the petition of Walt Tuvell appealing the nonresponse of the Town of Reading (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). From December 9, 2021 through December 23, 2021, Walt Tuvell made multiple requests for “…emails sent to/from any/all Select Board members” covering various date ranges; and on December 24, 2021, he provided a modification to the categories of senders, recipients, and contents of the emails he seeks. Previous Appeal This request is the subject of a previous determination. See SPR21/3374 Determination of the Supervisor of Records (January 4, 2022). In my January 4th determination, I encouraged “…Mr. Tuvell and the Town to continue to communicate to facilitate providing records more efficiently and affordably.” Conclusion In an email dated January 12, 2022, Mr. Tuvell sent the Town an inquiry concerning his request. Claiming to not yet have received a response, Mr. Tuvell petitioned this office, and this appeal, SPR22/0149, was opened as a result. As of the date of this letter, it is my understanding that the Town has not provided Mr. Tuvell a response to his request for records. Accordingly, the Town is ordered to provide Mr. Tuvell with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
