Murray Supervisor of Records February 11, 2022 SPR22/0206 Allison Mondello Primary RAO Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received a petition from Craig Shibley appealing the nonresponse of the Department of State Police (Department) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 13, 2022, Mr. Shibley requested the following records related to an identified case: 1. All case file evidence currently being stored at the Worcester SPDU's office on Lafayette St.; 2. All ballistic evidence recovered from the 1951 crime scene. Claiming to not yet have received a response, Mr. Shibley petitioned this office and this appeal, SPR22/0206, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Shibley with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Shibley may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
