The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records February 14, 2022 SPR22/0212 Claudia Buruca Records Access Officer Suffolk District Attorney’s Office One Bulfinch Place, Suite 300 Boston, MA 02114 Dear Ms. Buruca: I have received the petition of Evan Allen of the Boston Globe appealing the response of the Suffolk District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 7, 2021, Ms. Allen requested, “… complete files on the Oct. 23, 1989 homicide of [identified persons] … including: files relating to the John Doe grand jury; files relating to [identified persons] … relating to charges against [identified persons] … [and] any files … related to the subsequent police internal affairs inquiry …” The Office responded on December 6, 2021. Unsatisfied with the response, Ms. Allen petitioned this office and this appeal, SPR22/0212, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a subsequent response to Ms. Allen. Accordingly, the Office is ordered to provide Ms. Allen with said response in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Allen may appeal the substantive nature of Office's response within ninety days. See 950 C.M.R. 32.08(1).
