Martineau Executive Director City of Brockton – Retirement Board 1322 Belmont Street, Suite 101 Brockton, MA 02301 Dear Director Martineau: I have received the petition of Gar Chung of Financial Investment News appealing the nonresponse of the City of Brockton Retirement Board (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 3, 2021, Mr. Chung requested “…a copy of the OCIO presentations and if available, a recording and minutes of the November 2, 2021 board meeting.” Claiming to not yet have received responsive records, Mr. Chung petitioned this office and this appeal, SPR22/0213, was opened as a result. Subsequently, I learned that the Board provided a response dated February 4, 2022 to Mr. Chung’s request. Where the basis of this appeal was opened as a result of the Board’s lack of a written response, I will now consider this administrative appeal closed. Mr. Chung may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
