Murray Supervisor of Records February 10, 2022 SPR22/0222 Darcy Fernandes Superintendent of Schools Athol-Royalton Regional School District 1062 Pleasant Street Athol, MA 01331 Dear Superintendent Fernandes: I have received the petition of Ben Tobin appealing the nonresponse of the Athol- Royalston Regional School District (District) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Tobin requested: “the number of students in [D]istrict currently placed in approved [S]pecial [E]ducation schools (766 schools) broken down by placement. I would also like to request the MCAS scores for these same students.” After not receiving a response within ten days, Mr. Tobin petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within 10 business days from receipt of the request. G. L. c. 66, § 10(a)-(b). Despite being notified of the opening of this appeal, no response has been provided. Accordingly, the District is ordered to provide Mr. Tobin with a response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of the response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
