Ryan Fortier Malden Police Department Administration and Operations Division 800 Eastern Avenue Malden, MA 02148 Dear Lt. Fortier: I have received the petition of Joshua Dankoff of the Citizens for Juvenile Justice appealing the nonresponse of the City of Malden Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 4, 2021, Mr. Dankoff requested: 1. Data sharing and cooperation agreements or memorandums of understanding between [the Malden police and named authorities] . . .[;] 2. Policies concerning gathering and storing of gang information . . .[;] 3. Policies concerning stop and frisk and/or field interrogation[;] 4. . . . data for any person under the age of 21, all police documents sent to, transmitted to, or otherwise made available or accessible to [named authorities] [;] 5. Stop and frisk and/or field interrogation data for all stop and frisk / field interrogation incidents from 2016 through when the search is conducted in 2021 is requested. . . . [;] 6. Data regarding how many people have been identified by your department as gang affiliated, gang involved, or part of a 'threat risk group' [; and] 7. [Copies of school related records] [ . . . ] Claiming to not yet have received responsive records, Mr. Dankoff petitioned this office and this appeal, SPR22/0232, was opened as a result. Subsequently, I learned that the Department provided Mr. Dankoff with a response dated February 9, 2022. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Dankoff may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
