Murray Supervisor of Records February 18, 2022 SPR22/0283 Kathleen Spofford Town Clerk Town of Townsend 272 Main St Townsend, MA 01469 Dear Ms. Spofford: I have received the petition of Carolyn Smart appealing the nonresponse of the Town of Townsend (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 15, 2022, Ms. Smart requested the following records: [1] Any and all emails and/or communications to the payroll department regarding my wages or benefits from May of 2021 to present from [named persons]. [2]Any emails, communications and/or written legal opinions from Town or Labor Counsel regarding my wages or benefits from May of 2021 to present. Claiming to not yet have received responsive records, Ms. Smart petitioned this office and this appeal, SPR22/0283, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Ms. Smart with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Ms. Smart may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
