G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 18, 2022, Ms. Spaulding requested information regarding an identified complaint. Previous Appeal The records sought by Ms. Spaulding were the subject of a previous appeal. See SPR22/0085, Supervisor of Records Determination (January 18, 2022). There, I found that Ms. Spaulding’s appeal was untimely and I suggested that she submit a new request to the Department. Ms. Spaulding did so on January 18, 2022, and the Department provided her with a response on January 19, 2022. Unsatisfied with the Department’s response, Ms. Spaulding petitioned this office and this appeal, SPR22/0316, was opened as a result. In a conversation with a staff attorney in the Public Records Division, the Department indicated that it would provide a supplemental response to Ms. Spaulding. Accordingly, the Department is ordered to provide Ms. Spaulding with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Spaulding may appeal the substantive nature of the Division’s response within ninety days.
