Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Michael Saccone, appealing the response of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 7, 2022, Mr. Saccone requested a video from an accident involving an Authority vehicle. On February 8, 2022, the Authority responded. Unsatisfied with the Authority’s response, Mr. Saccone petitioned this office and this appeal, SPR22/0317, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Authority representative, it is my understanding that the Authority intends on providing a subsequent response to Mr. Saccone. Accordingly, the Authority is ordered to provide Mr. Saccone with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Saccone may appeal the substantive nature of the Authority’s response within ninety days.
