Fitzpatrick: I have received the petition of Frank Wood appealing the nonresponse of the Natick Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 18, 2021, Mr. Wood requested the following records: [1] …[a] copy of an agreement titled “LAST CHANCE AGREEMENT AND RELEASE OF ALL CLAIMS” between [identified person] and the New England Police Benevolent Association Local #2 and Natick Patrol Officers’ Association and the Town of Natick[;] [2] …[a] copy of any agreements between New England Police Benevolent Association Local #2 and the Natick Patrol Officers’ Association and the Town signed since 2018 referencing specific officers. Claiming to not yet have received responsive records, Mr. Wood petitioned this office and this appeal, SPR22/0381, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Wood with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Wood may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
