Berkshire District Attorney’s Office 7 North Street Pittsfield, MA 01201 Dear Attorney Dohoney: I have received the petition of Andrew Quemere appealing the response of the Berkshire District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 10, 2022, Mr. Quemere requested records regarding the Office’s Brady list. Mr. Quemere requested that the records be provided in an electronic format that is searchable and machine-readable. On January 18, 2022, Andrew McKeever, Director of Communications in the Office, informed Mr. Quemere that it received the request, was gathering records, and would contact him about a delivery date of the records. On February 16th, after not receiving a further response, Mr. Quemere petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In spite of the Office being notified of this appeal, no further response was provided to Mr. Quemere. Order Accordingly, the Office is ordered to provide Mr. Quemere with a response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the response within 90 calendar days. See 950 C.M.R. 32.08(1).
