Murray Supervisor of Records March 2, 2022 SPR22/0422 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Marion King appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2021, Ms. King requested: Please provide an organizational chart for the division and an official job description for each position and the name of the person(s) currently in each role. Please also provide any records reflecting an official or unofficial change to each job description. Please provide the resume of each person employed in this division, redacted of sensitive personal information as required by statute. Please also provide, for each of those people (i.e., only active employees, not former employees), records regarding all continuing education, official or unofficial, certifications, licenses and any other similar evidence of qualifications dating from 1-1-2015 through the date of your response. The Department provided a response on December 27, 2021. Unsatisfied with the Department’s response, Ms. King petitioned this office and this appeal, SPR22/0422, was opened as a result. Subsequently, the Department informed a staff attorney in the Public Records Division that it intends to provide a supplemental response. Accordingly, the Department is ordered to provide Ms. King with a written response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. King may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
