Legal Counsel Executive Office of Public Safety and Security 1 Ashburton Place, Room 2133 Boston, MA 02108 Dear Atty. Mullaney: I have received the petition of Emmett S. Muldoon appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 20, 2022, Mr. Muldoon requested: 1. All emails sent or received by, or on behalf of, [named individual] that relate of refer Emmett S. Muldoon or Emmett Muldoon, and that further request, as part of the $11,144,355 award by the Department of Justice (DOJ) to the EOPSS and September 20, 2020 Interdepartmental Service Agreement (ISA) between·EOPSS and the Department of Correction (DOC) . . . 2. Any and all documents related to or involved with Request # 1 above. 3. The same requests above at## 1 and 2, except as applied to [named individual]. Claiming to not yet have received responsive records, Mr. Muldoon petitioned this office and this appeal, SPR22/0434, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Muldoon with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Muldoon may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
