G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 4, 2022, Mr. Shibley requested the following records regarding digitizing an identified case file: 1. The individual and/or entity that ordered the digitization process; 2. The start & end date of the digitization process; 3. The individual(s) and /or entity that performed the file review process; 4. The start & end date of the file review process; 5. In an August 6, 2021 email you wrote the following: "They've requested that this [scanning] process be expedited." Identify who "they" is. 6. A catalog of the digitized case file … 7. The anticipated release date of the file … Previous appeals This request was the subject of a previous appeals. See SPR22/0137 Determination of the Supervisor of Records (February 1, 2022) and SPR22/0227 Determination of the Supervisor of Records (February 10, 2022). The Office responded on February 24, 2022. Unsatisfied with the Office’s response, Mr. Shibley petitioned this office and this appeal, SPR22/0459, was opened as a result. The Public Records Law The Public Records Law strongly favors disclosure by creating a presumption that all governmental records are public records. G. SPR22/0459 Page 2 March 11, 2022 form or characteristics, made or received by any officer or employee of any agency or municipality of the Commonwealth, unless falling within a statutory exemption. G. L. c. 4, § 7(26). It is the burden of the records custodian to demonstrate the application of an exemption in order to withhold a requested record. G. L. c. 66, § 10(b)(iv); 950 C.M.R. 32.06(3); see also Dist. Attorney for the Norfolk Dist. v. Flatley, 419 Mass. 507, 511 (1995) (custodian has the burden of establishing the applicability of an exemption). To meet the specificity requirement a custodian must not only cite an exemption, but must also state why the exemption applies to the withheld or redacted portion of the responsive record. The Office’s February 24th response In its February 24th response, the Office stated, “… as stated in our January 25, 2022 letter, there are no responsive records that exist and are within the possession, custody or control of our office that meet the parameters of any of the seven items listed in your request.” Upon review of the file, it is unclear if the Office created or received any records responsive to the request, has permissibly destroyed the records or if the records never existed. Consequently, the Office must clarify this. Conclusion Accordingly, the Office is ordered to provide Mr. Shibley with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days.
