Box 355 Rowley, MA 01969 Dear Mr. Brown: I have received the petition of Timothy Toomey appealing the response of the Rowley Municipal Lighting Plant (Plant) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 31, 2022, Mr. Toomey requested: Please provide any and all information relating to Town of Rowley Municipal Light (Rowley MA Power entity or Town of Rowley) for their [legal counsel’s] invoices/bills for legal services rendered regarding [certain categories of services]. The time period is August 2020 to present. The Plant provided Mr. Toomey a response on February 10, 2022. Unsatisfied with the Plant’s response, Mr. Toomey petitioned this office and this appeal, SPR22/0463, was opened as a result. Subsequently, in a telephone call between the Plant’s legal counsel and a staff attorney in the Public Records Division, the Plant informed this office that it intends on submitting a supplemental response. Accordingly, the Plant is ordered to provide Mr. Toomey with a written response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Toomey may appeal the substantive nature of the Plant’s response within ninety days.
