G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 11, 2022, Attorney Gero requested copies of the following records pertaining to Casella Waste Management: 1. … spreadsheets showing … calculations of the monthly ACR … [and] the per ton rebate charge/rebate to the Town … for its recycling for the months of December 2020 through January 2022 2. … invoices for services rendered to the Town for November 2021 through January 2022 3. .. tonage report for the month of January 2022. Previous appeal This request was the subject of a previous appeal. See SPR22/0408 Determination of the Supervisor of Records (March 4, 2022). The Town responded on March 2, 2022. Unsatisfied with the response, Attorney Gero petitioned this office and this appeal, SPR22/0523, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Attorney Gero. Accordingly, the Town is ordered to provide Attorney Gero with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days.
