See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 14, 2022, Mr. Sylbert requested, “[e]mails and/or texts between [named individuals] that are in [a named individual’s] possession.” Indicating he had not received responsive records, Mr. Sylbert petitioned this office and this appeal, SPR22/0528, was opened as a result. Subsequently, I learned that a representative from the Town intends on providing a written response to Mr. Sylbert. Accordingly, the Town is ordered to provide Mr. Sylbert with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Sylbert may appeal the substantive nature of the Town’s response within ninety days.
