Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite #3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Attorney Margaret Sheehan appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 21, 2021, Attorney Sheehan requested “…records relating to the transfer of property in Carver, MA from MassDOT to RPBT, LLC, [identified individual] or agents or partners of RPBT LL…” Despite the Department’s indication on February 9, 2022 that records were collected and were being reviewed, Attorney Sheehan has not yet have received responsive records. Consequently, Attorney Sheehan petitioned this office and this appeal, SPR22/0545, was opened as a result. Based upon a conversation between a Public Records Division staff member and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Attorney Sheehan. Accordingly, the Department is ordered to provide Attorney Sheehan with a response to her request in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Sheehan may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
