Harris appealing the response of the Town of Wayland (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 16, 2022, Mr. Harris requested records, in electronic format, pertaining to services provided to the Town by a project construction cost estimator, including those working with or for her/him, with respect to the Council on Aging/Community Center (or more generally if the services are to be used on more than one project). Specifically, [Mr. Harris] request[s] the following during the past two years: 1. All Requests for Bids/Quotations/Proposals to which the successful cost estimator responded; 2. The Bids/Quotations/Proposals the successful cost estimator submitted to the Town; 3. All contracts/service agreements between the Town and the successful cost estimator; 4. The accounting record(s) that show(s) all payments made by the Town to the successful cost estimator; and, 5. The accounting record(s) that show(s) the source(s) of funds paid to the successful cost estimator. After not receiving a response to the request, Mr. Harris petitioned the Supervisor of Records, and this appeal was opened. Despite being notified of the opening of this appeal, no response has been provided. Accordingly, the Town is ordered to provide Mr. Harris with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of the response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Harris may appeal the substantive nature of the response within 90 calendar days. 950 C.M.R. 32.08(1).
