Murray Supervisor of Records March 23, 2022 SPR22/0581 Michael Vigneux Records Access Officer City of Worcester 455 Main Street Worcester, MA 01608 Dear Mr. Vigneux: I have received the petition of Joseph Hennessey, Esq. appealing the response of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 16, 2022, Attorney Hennessey requested numerous records from the City, including, “[Line item] 14. All WPD internal emails between any officer involved in the arrest of [named individuals] on November 17, 2021.” Previous Appeal This request was the subject of a previous appeal. See SPR22/0441 Determination of the Supervisor of Records (March 9, 2022). The City responded on March 9, 2022. Claiming to not yet have received a response to line item 14, Attorney Hennessey petitioned this office and this appeal, SPR22/0581, was opened as a result. Subsequently, I learned that a representative from the City intends on providing a written response to Attorney Hennessey. Accordingly, the City is ordered to provide Attorney Hennessey with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Hennessey may appeal the substantive nature of the City’s response within ninety days.
