Clancy appealing the response of the Town of Reading (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 16, 2021, Mr. Clancy requested “for the period December 2, 2021 to December 16, 2021, for all e-mail correspondence to and from the previously referenced accounts, related to the Town Manager positon.” Following additional correspondence, the Town mailed Mr. Clancy a USB drive containing responsive records. Stating that “the USB did not survive the mailing,” Mr. Clancy appealed, and this case was opened as a result. Subsequent to the opening of this appeal, and based on an email to Mr. Clancy and this office on March 17, 2022, I learned that the Town has again mailed the responsive records to Mr. Clancy. This office encourages the Town and Mr. Clancy to continue communicating directly in order to arrange receipt of the records responsive to his request, if needed. Accordingly, I will now consider this administrative appeal closed. Mr. Clancy may further appeal the substantive nature of the Town’s March 15th response within ninety (90) days.
