Murray Supervisor of Records March 31, 2022 SPR22/0646 Jacqueline Cook Records Access Officer Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Ms. Cook: I have received the petition of Cora Flynn appealing the response of the Lowell Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 22, 2022, Ms. Flynn requested, “[a]ll or any reports sent from the Lowell Police Department to the Peace Officer Standards and Training (POST) Commission. Including but not limited the name of the officer, type of incident, date of incident, and result/reprimand (i.e. suspension, termination, etc.). All or any documents, incident reports, or spreadsheets that contain the aforementioned information submitted to the POST commission.” Prior appeal The responsive records were the subject of a prior appeal. See SPR22/0516 Determination of the Supervisor of Records (March 11, 2022). I closed my March 11th determination finding that the Department intended on providing a supplemental response to Ms. Flynn. On March 15, 2022, the Department responded. Unsatisfied with Department’s response, Ms. Flynn petitioned this office and this appeal, SPR22/0646, was opened as result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Ms. Flynn. Accordingly, the Department is ordered to provide Ms. Flynn with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Flynn may appeal the substantive nature of the Department’s response within ninety days.
