Assistant City Solicitor 45 School Street, City Hall Brockton, MA 02301 Dear Attorney Cogliano: I have received the petition of Attorney James P. McKenna appealing the nonresponse of the City of Brockton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 18, 2022, Attorney McKenna requested, “[a]ll public records, including all reports and correspondence, concerning the incident on September 29, 2021, in which [an identified individual] was given a citation…by a member of the Brockton Police Department.” Claiming to not yet have received a response, Attorney McKenna petitioned this office, and this appeal, SPR22/0652, was opened as a result. Subsequently, I learned that the City provided Attorney McKenna with a response dated March 28, 2022. In light of the City’s March 28th response, I will now consider this administrative appeal closed. Attorney McKenna may appeal the substantive nature of the City’s response within ninety days.
