Matthew LeMay Technical Services Commander Fitchburg Police Department 20 Elm Street Fitchburg, MA Dear Captain LeMay: I have received the petition of Attorney Mara Dolan appealing the response of the Fitchburg Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 17, 2022, Attorney Dolan requested, “…unredacted copies of any and all reports of officer misconduct” regarding a list of certain law enforcement officers. The Department provided a fee estimate on March 21, 2022. Unsatisfied with the Department’s response, Attorney Dolan petitioned this office and this appeal, SPR22/0670, was opened as a result. In a phone call between the Department and a staff attorney in the Public Records Division, the Department indicated that it would provide a supplemental response to Attorney Dolan. Accordingly, the Department is ordered to provide Attorney Dolan with a written response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Dolan may appeal the substantive nature of the Department’s response within ninety days.
