Box 35 Heath, MA 01346 Dear Ms. Summer: I have received the petition of Edward Whitaker appealing the response of the Town of Heath (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 16, 2021, Mr. Whitaker requested records relating to an application pending before the Town of Heath Conservation Commission. Unsatisfied with the Town’s response, Mr. Whitaker petitioned this office and this appeal, SPR22/0678, was opened as a result. Subsequently, I learned that the Town provided Mr. Whitaker with a response dated April 5, 2022. Where the basis of this appeal was opened as a result of the of the Town’s prior response, I will consider this administrative appeal closed. Mr. Whitaker may appeal the substantive nature of the Town’s April 5th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
