O’Brien appealing the response of the Middlesex District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On November 21, 2019, Mr. O’Brien requested, “… copy of all memos, police reports, police interviews, affidavits, indexes, station reports, case reports and witness interviews that were conducted by the Somerville Police Department, Massachusetts State Police, Middlesex County District Attorney’s Office and the Middlesex County District Attorney’s CPAC Unit.” The Office responded on December 28, 2021. Unsatisfied with the response, Mr. O’Brien petitioned this office and this appeal, SPR22/0679, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and the Office, it is my understanding that the Office intends on providing a further response to Mr. O’Brien. Accordingly, the Office is ordered to provide Mr. O’Brien with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. O’Brien may appeal the substantive nature of the Office's response within ninety days. See 950 C.M.R. 32.08(1).
