The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records March 30, 2022 SPR22/0693 Patricia Scanlon, Esq. Assistant General Counsel Executive Office of Health & Human Services 1 Ashburton Place, Room 1109 Boston, MA 02108 Dear Attorney Scanlon: I have received the petition of Jean Batty appealing the response of the Executive Office of Health & Human Services (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 23, 2021, Ms. Batty requested, “copies of all emails sent or responded to by [named individual] . . . that have the name ‘Jean Batty,’ or ‘Batty’ in the body of the email . . .” between August 19, 2021 and November 23, 2021. On February 22, 2022, the Office responded to Ms. Batty’s request. Unsatisfied with the Office’s response, Ms. Batty petitioned this office and this appeal, SPR22/0693, was opened as a result. Subsequently, I learned that the Office provided a further response dated March 29, 2022. Where the basis of this appeal was opened as a result of the Office’s February 22nd response, I will consider this administrative appeal closed. Ms. Batty may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
