King of SPREDWatch, Inc. appealing the response of the Benjamin Banneker Charter School (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. King requested a copy of the Letters of Finding for PRS 5821 and PRS 6047. The requested records were the subject of a prior determination. See SPR22/0486 Determination of the Supervisor (March 15, 2022). Where the School did not provide Ms. King with a response to her request, I ordered the School to provide a response within ten (10) business days. On March 18, 2022, the School provided Ms. King with copies of Letters of Closure for complaints PRS 5821 and PRS 6047. As a result, Ms. King petitioned the Supervisor of Records (Supervisor), and the current appeal, SPR22/0698, was opened. In a March 25th email to the School and copied to this office, Ms. King reported, “I received a list from DESE/PRS of Letters of Finding issued. Given that they did not in fact issue a Letter of Finding and actually issued a Letter of Closure instead, I withdraw my request and my appeals.” Accordingly, I will consider this administrative appeal closed.
