Deputy Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Daniel Jaffe of the Committee for Public Counsel Services - Strategic Litigation Unit appealing the nonresponse of the Department of the Massachusetts State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 19, 2022, Mr. Jaffe requested, “[a] spreadsheet containing… data pertaining to each time the Massachusetts State Police Department or any employee thereof has been criminally prosecuted for actions or omissions committed in the course of employment after January 1, 2010.” Claiming to not yet have received responsive records, Mr. Jaffe petitioned this office and this appeal, SPR22/0711, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Jaffe with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Jaffe may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
